Are you asking if it is OK to try and avoid paying for the damage caused to the vehicle that you turned in front of? The fact that they may have been speeding and have bald tires is immaterial here. They had right of way and you didn't. I think you will find it to be about that simple. I noticed that at the bottom of the form that you scanned there is a line about submiting an SR-1 form, and that failure to do so will result in the suspension of your licence. I would suggest that you comply with that and do what you have to do. If on the other hand you are simply asking because you are an inexperienced driver and are usure of where you stand and what needs to be done, then I apologise if my tone seemed at all harsh, but the answer is still the same.
